Allgemeine Geschäftsbedingungen (AGB)
1. Geltungsbereich
1.1 Diese allgemeinen Geschäftsbedingungen (nachfolgend «AGB») bilden die Grundlage für jegliche Verträge bezüglich Dienstleistungen zwischen Napat Yoga & Massage (nachfolgend «Anbieter») und Kundinnen und Kunden (nachfolgend «Kunden»).
1.2 Mit der Nutzung unserer Dienstleistungen erklären Sie sich ausdrücklich mit den Allgemeinen Geschäftsbedingungen einverstanden. Die AGB sind Bestandteil jedes Vertrages und können jederzeit auf unserer Homepage eingesehen werden.
2. Haftungsausschluss
2.1 Der Anbieter übernimmt keinerlei Gewähr hinsichtlich der inhaltlichen Richtigkeit, Genauigkeit, Aktualität, Zuverlässigkeit und Vollständigkeit der Informationen.
2.2 Haftungsansprüche gegen den Anbieter wegen Schäden materieller oder immaterieller Art, welche aus dem Zugriff oder der Nutzung beziehungsweise Nichtnutzung der veröffentlichten Informationen, durch Missbrauch der Verbindung oder durch technische Störungen entstanden sind, werden ausgeschlossen.
2.3 Alle Angebote sind unverbindlich. Der Anbieter behält es sich ausdrücklich vor, Teile der Seiten oder das gesamte Angebot ohne besondere Ankündigung zu verändern, zu ergänzen, zu löschen oder die Veröffentlichung zeitweise oder endgültig einzustellen.
2.4 Verweise und Links auf Webseiten Dritter liegen ausserhalb des Verantwortungsbereichs des Anbieters. Es wird jegliche Verantwortung für solche Webseiten abgelehnt. Der Zugriff und die Nutzung solcher Webseiten erfolgen auf eigene Gefahr der Kunden.
3. Leistungen
3.1 Der Anbieter erbringt Massage- und Therapieleistungen nach den Grundsätzen der traditionellen thailändischen Massage, Nuad Thai genannt.
3.2 Der Anbieter übernimmt keine Heilversprechen. Die Behandlungen dienen der Entspannung, Schmerzlinderung und Förderung des Wohlbefindens.
3.3 Im Rahmen der Anamnese ist der Kunde verpflichtet, den Anbieter umfassend über seinen Gesundheitszustand zu informieren.
4. Terminvereinbarung und Absage
4.1 Termine sind verbindlich.
4.2 Wir bitten Kunden, vereinbarte Termine mindestens 12 Stunden im Voraus abzusagen. Bei kurzfristigeren Absagen oder Nichterscheinen behalten wir uns vor, den vollen Behandlungspreis in Rechnung zu stellen.
5. Zahlung
5.1 Die Behandlungen sind sofort nach der Leistung durch Kunden in bar oder per Twint in Schweizer Franken [CHF] zu begleichen.
5.2 Für Gutscheine und Mobile Massage gelten gesonderte Bedingungen.
6. Gutscheine
6.1 Gutscheine können als persönliche oder unpersönliche Gutscheine ausgestellt werden.
6.2 Der maximale Wert pro Gutschein ist auf CHF 1'000.00 begrenzt. Gutscheine sind ab Ausstellungsdatum für 1 Jahr gültig. Wir weisen jedoch darauf hin, dass die gesetzliche Verjährungsfrist für Gutscheine in der Schweiz gilt. Nach Ablauf dieser Frist verliert der Gutschein seine Gültigkeit und kann nicht mehr eingelöst werden. Eine Verlängerung der Gültigkeitsdauer ist ausgeschlossen.
6.3 Ein Gutschein ist nur gültig und einlösbar, wenn er vollständig bezahlt wurde. Bei der Bezahlung des Gutscheins muss die Gutscheinreferenz deutlich vermerkt werden, um eine eindeutige Zuordnung zu gewährleisten. Ohne diesen Vermerk kann die Aktivierung des Gutscheins verzögert oder abgelehnt werden.
6.4 Gutscheine können für alle Dienstleistungen eingelöst werden, für die der jeweilige Gutschein gilt. Eine Teileinlösung ist möglich; der Restbetrag verbleibt auf dem Gutschein und kann zu einem späteren Zeitpunkt eingelöst werden. Dies ist gültig, solange die Gültigkeitsdauer ab Ausstellungsdatum nicht abgelaufen ist. Der kleinste einlösbare Teilbetrag entspricht dem tiefsten Angebot der jeweiligen Dienstleistung.
6.5 Eine Barauszahlung des Gutscheinwertes ist ausgeschlossen. Gutscheine können nicht umgetauscht oder zurückgegeben werden.
6.6 Bei Verlust, Diebstahl oder Unleserlichkeit des Gutscheins wird kein Ersatz geleistet. Bewahren Sie Ihren Gutschein sorgfältig auf.
7. Haftung
7.1 Wir weisen darauf hin, dass Massagen und Therapien bei bestimmten Vorerkrankungen oder körperlichen Zuständen zu Nebenwirkungen führen können. Bitte informieren Sie uns vor der Behandlung über alle relevanten gesundheitlichen Aspekte. Wir sind bemüht, die Behandlungen sorgfältig und nach bestem Wissen und Gewissen durchzuführen
7.2 Der Anbieter haftet nur für Schäden, die durch grobe Fahrlässigkeit oder Vorsatz verursacht werden.
8. Datenschutz
8.1 Der Anbieter behandelt alle Kundendaten vertraulich und gemäss den geltenden Datenschutzbestimmungen.
8.2 Zur Bearbeitung Ihrer Anfrage und zur Terminvereinbarung speichern wir Ihre persönlichen oder geschäftlichen Daten (Name, Telefonnummer, E-Mail-Adresse, vollständige Anschrift/Geschäftsadresse). Diese Daten werden ausschliesslich zur Bearbeitung Ihrer Anfrage und zur Kommunikation mit Ihnen verwendet.
8.3 Für die Nutzung unseres Online-Buchungstools gelten ergänzend die AGB unseres Dienstleisters localsearch. Bitte beachten Sie die entsprechenden Bestimmungen.
8.4 Sie haben jederzeit das Recht auf Auskunft Ihrer bei uns gespeicherten Daten. Bitte wenden Sie sich hierfür an info (at) napat-yoga-massage.com .

9. Salvatorische Klausel
Sollten einzelne Bestimmungen dieser AGB unwirksam sein, so wird die Wirksamkeit der übrigen Bestimmungen hiervon nicht berührt. Im Übrigen gelten die gesetzlichen Bestimmungen. Für diese Allgemeinen Geschäftsbedingungen gilt ausschliesslich Schweizer Recht. Im Falle von Widersprüchen zwischen der deutschen und der englischen Fassung ist die deutsche Fassung massgeblich.
10. Gerichtsstand
Erfüllungsort und Gerichtsstand ist Zürich (Schweiz).
General Terms and Conditions (GTC)

1.1 These general terms and conditions (hereinafter referred to as «GTC») form the basis for all contracts regarding services between Napat Yoga & Massage (hereinafter referred to as «Provider») and customers (hereinafter referred to as «Customers»).
1.2 By using our services, you expressly agree to the General Terms and Conditions. The GTC are part of every contract and can be viewed on our homepage at any time.
2. Disclaimer
2.1 The provider assumes no liability for the accuracy, completeness, or timeliness of the information provided.
2.2 Liability claims against the provider for damages of a material or immaterial nature arising from access to or use or non-use of the information provided, through misuse of the connection, or through technical faults are excluded.
2.3 All offers are non-binding. The provider expressly reserves the right to change, supplement, or delete parts of the pages or the entire offer without prior 1 notice or to temporarily or permanently cease publication.
2.4 References and links to third-party websites are outside the responsibility of the provider. Any responsibility for such websites is rejected. Access to and use of such websites are at the customer's own risk.
3. Services
3.1 The provider provides massage and therapy services based on the principles of traditional Thai massage, called Nuad Thai.
3.2 The provider makes no healing promises. The treatments serve relaxation, pain relief, and the promotion of well-being.
3.3 As part of the anamnesis (medical history), the customer is obliged to provide the provider with comprehensive information about their state of health.
4. Appointment and Cancellation
4.1 Appointments are binding.
4.2 We ask customers to cancel agreed appointments at least 12 hours in advance. For cancellations at shorter notice or no-shows, we reserve the right to charge the full treatment price.
5. Payment
5.1 The treatments are to be paid immediately after the service by customers in cash or via Twint in Swiss Francs [CHF].
5.2 Separate conditions apply to vouchers and mobile massage.
6. Vouchers
6.1 Vouchers can be issued as personal or non-personal vouchers.
6.2 The maximum value per voucher is limited to CHF 1,000.00. Vouchers are valid for 1 year from the date of issue. However, please note that the statutory limitation period for vouchers in Switzerland applies. After this period, the voucher expires and can no longer be redeemed. An extension of the validity period is excluded.
6.3 A voucher is only valid and redeemable if it has been fully paid for. When paying for the voucher, the voucher reference must be clearly stated to ensure unambiguous assignment. Without this reference, voucher activation may be delayed or refused.
6.4 Vouchers can be redeemed for all services for which the respective voucher is valid. Partial redemption is possible; the remaining balance stays on the voucher and can be redeemed at a later time. This is valid as long as the validity period from the date of issue has not expired. The smallest redeemable partial amount corresponds to the lowest offer of the respective service.
6.5 A cash payout of the voucher value is excluded. Vouchers cannot be exchanged or returned.
6.6 In case of loss, theft, or illegibility of the voucher, no replacement will be provided. Please keep your voucher carefully.
7. Liability
7.1 We would like to point out that massages and therapies can lead to side effects in certain pre-existing conditions or physical conditions. Please inform us of all relevant health aspects before the treatment. We make every effort to carry out the treatments carefully and to the best of our knowledge and belief.
7.2 The provider is only liable for damage caused by gross negligence or intent.
8. Data Protection
8.1 The provider treats all customer data confidentially and in accordance with the applicable data protection regulations.
8.2 To process your request and arrange appointments, we store your personal or business data (name, telephone number, email address, full address/business address). This data is used exclusively to process your request and to communicate with you.
8.3 The GTC of our service provider localsearch also apply to the use of our online booking tool. Please note the corresponding provisions.
8.4 You have the right to access your data stored by us at any time. Please contact info (at) napat-yoga-massage.com for this purpose.
8.5 We are currently working with the following companies to provide websites or the online booking tool. Information on data processing by the service providers can be found in their data protection declaration.
9. Severability Clause
Should individual provisions of these GTC be ineffective, this shall not affect the effectiveness of the remaining provisions. Otherwise, the statutory provisions shall apply. Swiss law shall apply exclusively to these General Terms and Conditions. In the event of contradictions between the German and English versions, the German version shall prevail.
10. Place of Jurisdiction
Place of performance and jurisdiction is Zurich (Switzerland).
